Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Hodi Homes platform, website, or mobile application (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Eligibility and Account

To use the Platform you must be at least 18 years of age, resident in Kenya, and hold a valid Kenyan mobile number. By registering, you represent and warrant that all information you provide is accurate and current.

3. User Roles

The Platform supports three roles: Tenants (browse and book viewings), Landlords (post and manage listings after ID verification), and Mover companies (vetted businesses bookable via the Movers section). A user may operate in both Tenant and Landlord mode.

4. No-Commission Model

Hodi does not charge tenants or landlords any commission, finder's fee, or success fee on rent. Fees for premium features, if introduced in future, will be disclosed clearly before any charge is made.

5. Viewings & Bookings

The Platform enables tenants to request property viewings directly with landlords. Hodi is not a party to any lease, tenancy agreement, or viewing appointment. Landlords are responsible for confirming, rescheduling, or cancelling viewings in a timely manner.

6. Listing Accuracy

Landlords warrant that all information in their listings — including photos, rent, deposit, and amenities — is accurate and not misleading. Hodi reserves the right to remove listings that violate this obligation without prior notice.

7. Prohibited Conduct

You agree not to:

• Post false, misleading, or duplicate listings.
• Impersonate another person or organisation.
• Harass, threaten, or abuse other users.
• Solicit payments outside the Platform's recommended channels.
• Scrape, copy, or republish Platform content without permission.

8. Platform Intermediary

Hodi is a technology platform that connects tenants with landlords and mover companies. We are not a landlord, letting agent, or moving company, and accept no liability for the condition of properties or the quality of moving services.

9. Payments

Hodi does not collect or process rent payments. All rent, deposit, and moving payments are made directly between users. Hodi recommends using traceable M-Pesa transactions and retaining all payment records.

10. Intellectual Property

All Platform content, branding, and software are owned by or licensed to Hodi Homes Ltd. You may not reproduce or distribute them without written permission, except as permitted by Kenyan copyright law.

11. Liability & Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by Kenyan law, Hodi excludes all warranties and liability for indirect, incidental, or consequential losses arising from your use of the Platform.

12. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via SMS or in-app notification. Continued use of the Platform after notice constitutes acceptance of the revised Terms.
